Summary of Board Actions During its January 19, 2001 meeting, the Board voted to issue: One Revocation One Summary Suspension One Practice Restriction One Decree of Censure Five Letters of Reprimand One case, involving 3 complaints, was Referred to Formal Hearing Adjudication Process Changes The Board approved a revised 4-stage investigation/adjudication process. The updated proposal includes establishing a Review Committee to conduct formal interviews, negotiate consent agreements and request legal staff to draft findings of fact, conclusions of law, and orders. The full Board will vote on all proposed orders and take final disposition on all referrals from the Office of Administrative hearings. The changes continue to provide for additional input from the Office of the Attorney General and provide for more efficient disposition of non-sustained complaints. This process also grants more options to the Board and the licensee in resolving sustained complaints. Substantive Policy Statements The Board approved a substantive policy statement outlining procedures for appealing an Executive Director action to the Board, specifically dismissals. The Board also approved an SPS which Delegated Authority to the Executive Director to refer cases directly to Formal Hearing. This is an amendment to the substantive policy statement, which previously allowed the Executive Director to only refer subsequent cases to Formal Hearing.
